I have been told that prototype plans can be amended (e.g. for cross tested formulas) and submitted as volume submitter plans, Is this true?
No. However, at least one prototype Mass Submitter took their Mass Submitter Document and Adoption Agreements and added cross tested formulas and then submitted the plans to the IRS as volume submitter specimen plans and received a volume submitter letter. This means that the volume submitter plan looks like a prototype, but is not a prototype. When in doubt check the Document Sponsor's Opinion or Advisory letter.
